Is it only plagiarism when you copy it and the person who wrote it has a right to be mad?

The person selling you the essay has presumably written it herself; she is no plagiarist. As for the buyer, well, that's a different story. =)
So the paper's not plagiarized yet, but it will be as soon as you turn it in.
